TERMS & CONDITIONS

  • Introduction

    • 1.1 These Terms & Conditions (“Terms”) govern your use of the Smart Lock Booking application (“the App”), provided by Smart Lock Booking on behalf of Devonport City Council (“we,” “us,” or “our”)

    • 1.2 By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not accept these Terms, you must not use the App.

  • Purpose of the App

    • 2.1 The App enables users to unlock certain Devonport City Council facilities using a smart lock system.

    • 2.2 You must provide your name and phone number to create an account and to receive One-Time Passcodes (OTP) for access.

  • Eligibility & Age

    • 3.1 There is no explicit age restriction for using the App; individuals under 16 may register. By registering, you confirm that you have the legal capacity to agree to these Terms (or have the consent of a parent/guardian if required by local law).

    • 3.2 If you are under 16, you represent that you have permission from a parent or guardian to use the App.

  • Account Creation & Security

    • 4.1 You agree to provide truthful, accurate, and complete information when registering, including your name and phone number.

    • 4.2 You are responsible for keeping your OTP confidential. You accept responsibility for all activity that occurs under your account.

  • Use of the App

    • 5.1 You must use the App in accordance with all applicable laws and regulations.

    • 5.2 You shall not use the App for any illegal or unauthorised purpose, including tampering with or damaging the locked facilities.

  • Data Collection & Privacy

    • 6.1 We collect your name, phone number, and logs of facilities you unlock (including date and time).

    • 6.2 We may retain such data indefinitely unless you request deletion.6.3 Please refer to our Privacy Policy for full details on how we handle your personal data.

  • Marketing & Contact

    • 7.1 Users may opt in to receive marketing communications. If you have opted in, we may send you promotional messages via SMS or other means.

    • 7.2 If facilities are damaged, we reserve the right to contact users who unlocked the facility during the relevant time frame.

  • Intellectual Property

    • 8.1 Ownership

        • All content, trademarks, logos, and designs in the App (except for the Devonport Council logo and branding) are owned by Smart Lock Booking or licensed to us by third parties.

        • The Devonport Council logo and related marks are owned by Devonport City Council.

        • You receive no rights to any logos, marks, or content beyond what is necessary to use the App in accordance with these Terms.

    • 8.2 Prohibited Use

        • You shall not copy, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, transmit, or otherwise exploit any part of the App or its content (including the Devonport Council logo and other trademarks) without prior written permission from the respective owners.

  • Limitation of Liability

    • 9.1 The App is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free service.

    • 9.2 To the extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of or inability to use the App.

  • Termination

    • 10.1 We reserve the right to terminate or suspend your access to the App at any time, with or without notice, if we believe you have violated these Terms or engaged in misuse of the App.

    • 10.2 You may delete your account or cease using the App at any time.

  • Changes to These Terms

    • 11.1 We may update or modify these Terms from time to time. We will notify you of any substantial changes, for example by posting an update in the App. By continuing to use the App after changes are posted, you agree to the revised Terms.

  • Governing Law & Disputes

    • 12.1 These Terms are governed by and construed in accordance with the laws of Tasmania, Australia, unless local regulations require otherwise

    • 12.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of Tasmania (or as mandated by your local jurisdiction).
